PLEASE READ THIS END USER LICENSE AGREEMENT (“AGREEMENT”) CAREFULLY BEFORE USING THE METICULOUS DRIVER APPLICATION (“APPLICATION”). BY USING THE APPLICATION, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL OR USE THE APPLICATION.
License Grant
Meticulous Technologies Inc. (“Licensor”) hereby grants you (“User”) a non-exclusive, non-transferable, limited license to install and use the Meticulous Driver Application (“Application”) solely for your personal or business purposes, subject to the terms and conditions of this Agreement.
Restrictions
You may not:
– Modify, reverse engineer, decompile, or disassemble the Application.
– Sell, transmit, or otherwise commercially exploit the Application.
– Distribute, rent, lease, or lend the Application to any third party.
– Use the Application in any manner that violates any laws or regulations.
– Use the Application to create derivative works based on the Application.
Ownership
The Application, its contents, and all trademarks associated with it are the exclusive intellectual property of Meticulous Technologies Inc. This Agreement does not grant you any ownership rights to the Application.
User-Generated Content
The Application allows users to create content, including text and images. By submitting content through the Application, you grant Meticulous Technologies Inc. the right to use, modify, and distribute this content without compensation or credit. We may implement any feedback or suggestions you provide at our discretion.
Personal Information
The Application collects certain personal information from users, including email addresses. By using the Application, you agree to the collection and use of this information in accordance with our Privacy Policy, which can be found at https://meticuloustechnologies.com/privacy-policy/.
Updates and Upgrades
The Application will be updated regularly with new features and maintenance. These updates or upgrades are subject to the terms of this Agreement unless they come with their own license agreement.
Termination
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term of this Agreement. Upon termination, you must cease all use of the Application and destroy all copies of the Application.
Disclaimer of Warranties
THE APPLICATION IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE APPLICATION.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Calgary, Alberta.
Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Entire Agreement
This Agreement constitutes the entire agreement between you and Licensor concerning the Application and supersedes all prior or contemporaneous understandings regarding such subject matter.
